AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement between you ("you" or "user") and Wayside Christian Mission, a Kentucky nonprofit organization ("Wayside," "we," "us," or "our"), governing your access to and use of our website at www.waysidechristianmission.org, including any forms, chatbot features, donation tools, volunteer signup systems, and SMS/text messaging programs associated with the site (collectively, the "Site").

By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please discontinue use of the Site immediately.

We reserve the right to update these Terms at any time. Changes will be reflected in the "Last Updated" date above. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

WHO MAY USE THIS SITE

The Site is intended for users who are at least 13 years of age. Users who are minors (under 18) must have the permission of and be supervised by a parent or guardian. By using the Site, you represent that you meet these requirements and that your use will comply with all applicable laws and regulations.

INTELLECTUAL PROPERTY

All content on this Site — including text, photographs, video, audio, graphics, logos, and the Wayside Christian Mission name and marks — is the property of Wayside Christian Mission or its licensed content providers and is protected by U.S. and international copyright and trademark law.

You are granted a limited, non-commercial license to access and use the Site and to download or print materials for personal, informational use only. You may not reproduce, republish, redistribute, sell, or commercially exploit any Site content without our express prior written permission.

We welcome the sharing of our content on social media for the purpose of promoting Wayside's mission, provided proper attribution is given and the content is not altered.

DONATIONS

Wayside Christian Mission is a 501(c)(3) nonprofit organization. Donations made through this Site are tax-deductible to the extent permitted by law. We will provide a receipt or acknowledgment for qualifying donations.

All online donations are processed through secure, third-party payment processors. Wayside does not store full credit card numbers. By submitting a donation, you authorize the transaction and represent that you are the authorized account holder.

Donations are generally non-refundable. If you believe a donation was made in error, please contact us promptly at wcm@waysidechristianmission.org or 502-584-3711 and we will do our best to assist you.

VOLUNTEER SIGN-UPS AND FORMS

By submitting a volunteer application, intake form, or release agreement through this Site, you acknowledge that the information you provide is accurate and complete. Volunteer release forms submitted electronically carry the same weight as physical signatures. Wayside reserves the right to accept or decline volunteer applications at its discretion.

SMS / TEXT MESSAGING PROGRAM

By opting in to receive text messages from Wayside Christian Mission, you agree to receive automated or manually sent SMS messages related to volunteer opportunities, events, ministry updates, and other mission-related communications.

Message and data rates may apply.
You are not required to consent to receive text messages as a condition of volunteering, donating, or receiving any services from Wayside.
To opt out at any time, reply STOP to any text message. You will receive one final confirmation message and no further texts.

Wayside is not responsible for delayed or undelivered messages due to carrier issues.

CHATBOT AND WEB FORM SUBMISSIONS

Our Site may include an interactive chatbot or contact forms to help answer questions and route inquiries. By using these features, you understand that:

Your submissions may be received and reviewed by Wayside staff and/or our third-party chatbot platform provider.
You should not submit sensitive personal, financial, or medical information through the chatbot.
Chatbot responses are informational only and do not constitute professional legal, medical, financial, or crisis counseling advice.
If you or someone you know is in immediate danger, please call 911. For crisis support resources, call or text 988 (Suicide & Crisis Lifeline).

USER CONDUCT AND PROHIBITED ACTIVITIES

You agree to use this Site only for lawful purposes and in a manner consistent with Wayside's mission and values. You agree not to:

Attempt to gain unauthorized access to any portion of the Site or its systems
Upload or transmit viruses, malware, or any disruptive or harmful code
Scrape, harvest, or systematically collect data from the Site without written permission
Impersonate Wayside, its staff, or any other person or entity
Use the Site to harass, threaten, or harm any individual
Submit false, misleading, or fraudulent information through any form or donation tool
Use automated scripts, bots, or data-mining tools to interact with the Site
Engage in any activity that interferes with the normal operation of the Site
Use the Site in any way that violates applicable federal, state, or local law

Wayside reserves the right to restrict or terminate access to the Site for any user who violates these Terms.

USER SUBMISSIONS AND CONTRIBUTIONS

The Site may allow you to submit comments, testimonials, prayer requests, or other content ("Contributions"). By submitting a Contribution, you grant Wayside a non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute your Contribution in connection with our ministry communications, including the Waysider Newsletter, social media, and our website.

You represent that your Contributions are your own, do not infringe on the rights of others, and are not false, defamatory, obscene, or unlawful. Wayside reserves the right to remove any Contribution at any time and for any reason without notice.

THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites (such as social media platforms, payment processors, or partner organizations). These links are provided for convenience only. Wayside does not control, endorse, or assume responsibility for the content, privacy practices, or accuracy of any third-party site. Your use of third-party sites is at your own risk and subject to their respective terms and policies.

We care about your privacy. Please review our full Privacy Policy at www.waysidechristianmission.org/privacy-policy, which is incorporated into these Terms by reference. By using the Site, you agree to the data practices described in our Privacy Policy.

DISCLAIMER OF WARRANTIES

THE SITE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WAYSIDE MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE IS ENTIRELY AT YOUR OWN RISK.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WAYSIDE CHRISTIAN MISSION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE SIX MONTHS PRECEDING THE CLAIM.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Wayside Christian Mission and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your Contributions, or your violation of these Terms.

DISPUTE RESOLUTION

We hope any concerns can be resolved informally. Please contact us first at wcm@waysidechristianmission.org or 502-584-3711 and allow us 30 days to work toward a resolution before initiating any formal proceeding.

If informal resolution is unsuccessful, any dispute arising from these Terms or your use of the Site shall be resolved through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA), conducted in Jefferson County, Kentucky. Both parties waive the right to participate in class-action proceedings. Disputes involving intellectual property rights, privacy violations, or requests for injunctive relief may be brought in court without prior arbitration.

GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Jefferson County, Kentucky.

ELECTRONIC COMMUNICATIONS

By using this Site, submitting forms, or signing up for communications, you consent to receive electronic communications from Wayside, including email and SMS, in accordance with our Privacy Policy. Electronic agreements and signatures carry the same legal weight as written signatures.

MODIFICATIONS AND AVAILABILITY

Wayside reserves the right to modify, suspend, or discontinue any portion of the Site at any time without notice or liability. We make no guarantee of continuous or uninterrupted availability.

SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wayside Christian Mission regarding use of the Site.
